Every company in this newsletter exists behind a wall. Nucor’s steel margins. Century Aluminum’s smelter economics. Generac’s pricing power. New Balance’s factory competitiveness. All of it depends on a tariff regime that makes Chinese imports expensive enough for American manufacturing to survive.

That regime is Section 301\. It started in 2018, survived a change of president, got raised three times, and was upheld by the Supreme Court in February 2026\. It now covers over **25,000 product codes** and every strategic sector in the U.S. economy. Today I’m going to explain what it is, what it covers, and why it’s the foundation under every reshoring story you’ve read.

Section 301 of the Trade Act of 1974 gives the president authority to impose tariffs in response to unfair trade practices. In 2018, USTR imposed tariffs on Chinese goods across four lists — covering roughly $370 billion in annual imports. Lists 1 through 3 carry a 25% surcharge. List 4A carries 7.5%.

Then came the strategic escalation. After a four-year statutory review, rates on specific sectors were raised dramatically through 2024, 2025, and January 2026\. Here are the current numbers for the sectors that matter most to this newsletter.

And these rates stack. Chinese steel faces 25% Section 301 plus 50% Section 232 — a total effective rate of 75%. Section 122’s 10% surcharge does not apply to goods already subject to Section 232 tariffs, per the February 20 proclamation. Chinese consumer goods on Lists 1–3 face about 35% effective duty. At those levels, sourcing from China is no longer the default. Companies are moving production to Vietnam, Mexico, India, and — increasingly — back to the United States.

**In February 2026, the Supreme Court struck down IEEPA-based tariffs** — the reciprocal and fentanyl tariffs imposed under emergency authority. But Section 301 uses a completely different statute: the Trade Act of 1974\. It was unaffected. The ruling confirmed that Section 301 tariffs rest on solid legal ground and are effectively permanent.

That distinction matters. USTR launched two new Section 301 investigations in March — one targeting excess manufacturing capacity in 16 economies, another targeting forced labor. Rate increases from these investigations could arrive by late 2026\. The wall is not just holding. It’s getting higher.

Here’s the investment takeaway. Section 301 is not going away. It survived Obama-era policy, Trump 1.0 imposition, Biden maintenance, Trump 2.0 expansion, and a Supreme Court challenge. Both parties support it. USTR is actively expanding it. The legal foundation is settled.

That means the reshoring thesis has a floor. Every company we’ve profiled operates behind this wall. From Nucor’s steel mills to BWXT’s reactors to Rockwell’s automation lines — all of them benefit from Chinese competition being structurally disadvantaged. The tariff wall is the reason. Remove it, and the economics of American manufacturing change overnight. Keep it, and the reshoring wave continues.

One more thing worth noting. The $800 de minimis exemption — which let small packages from China enter the U.S. duty-free — was eliminated in May 2025\. That closed the last loophole. Every parcel from China, including Shein and Temu shipments, now requires formal customs entry with full duty payment. The wall has no gaps.

The risk? Tariffs raise costs for consumers and downstream manufacturers who use Chinese inputs. They invite retaliation — China restricted rare earth exports in response. And they don’t last forever if political will shifts. But right now, the wall is high, legal, bipartisan, and rising. That’s the foundation under every story we’ve told.
